FAIR PROCESSING POLICY
 
Where we obtain information about you from

1. Telephone monitoring: We may monitor and/or record our telephone conversations with you.

2. Our records & credit reference agencies: When considering your application, we will search records held by the Genesis Capital (Finance & Leasing) Limited and your records at credit reference agencies (CRs) who will give us shared credit information, fraud prevention information, and public information (such as details of County Court Judgments, bankruptcies and information from the electoral register). Our background funders (list available on request) may also do similar searches. The information CRs give us about you may already be linked to information about someone else you have had a joint account or similar financial association with, including members of the same household. By submitting an application, you confirm that their finances will not affect our decision. We will check this and may turn down the application if we find it is inaccurate.

3. Colleagues: You must be sure that you are entitled to reveal information about your business partners, including your company directors (if you have any) and authorise us to use their information in the same way as your information, as described below.

How your information will be used
1. Prevention of Fraud: We will check your details with fraud prevention agencies (FPs). If you give us false or inaccurate information and we suspect or identify fraud we will record this and may also pass this information to FPs and other organisations involved in crime and fraud prevention.

2. Credit reference: We may also share your information (and information about any joint applicant) with CRs. This information remains on the CRs’ files for 6 years after the account is closed (whether settled by you or upon default). Whether or not your application proceeds, the CRs will add to your record details of our searches and your application. This record (but not our name) will be seen by other organisations when you apply for credit in the future. A large number of applications within a short period of time could affect your ability to obtain credit. We will also add to your record with the CRs details of your business’ agreement with us, the payments your business makes under it, and any default or failure to keep to its terms. An ‘association’ between joint applicants (between you and your business partner, for example) will be created at CRs. This will link your financial records, each of which will be taken into account in all future applications by either or both of you. This will continue until one of you successfully applies to the CRs to have the association removed.

3. Use of FPs & CRs information: The information held by the FPs and CRs will be disclosed to us and other organisations (in the UK and in other countries) to, for example:
(a) prevent fraud and money laundering by checking details on, for example, applications for credit and credit-related or other facilities, proposals and claims for all types of insurance and job applications and employee records;
(b) verify your identity; trace your whereabouts; or recover debts that you owe;
(c) manage credit accounts and other facilities; or to make decisions on credit, insurance and other facilities, about you, your financial associate(s), members of your household or your business; and 
(d) carry out statistical analysis (to help with decisions about credit and account management); or carry out market research.

4. Credit scoring: We may use credit scoring or other automated decision-making systems to assess your application and to verify your identity.

5. Transfer abroad: To provide you with the service you have asked for, we may share your information with organisations working under our instruction outside the European Economic Area, provided that appropriate security measures are in place.

6. Systems testing: We may use your information for testing our systems. When we do this, we will still keep your information private and confidential (and where practical, your information will be anonymised.)

7. Assignees: We may also share your information with any person or business (and their advisers) who might take over our rights or responsibilities under our agreement with you to allow them to prepare for taking these over – and after that, we may allow that person or business to use and share your information on the same basis as us.

8. Other disclosures: We may share your information with your agents and service providers in connection with the service they provide to you. We may also share it with others where: we have your permission; we have to do so or are allowed to do so by law; we have a duty to the public to reveal the information; or our legitimate interests mean we must share the information.

9. Keeping you informed: Genesis Capital (Finance & Leasing) Limited may provide you with information about their other products and services by post, phone or e-mail, but only if you have given consent to allow us to do this.

Your rights
1. Access: You have the right to receive a copy of certain information we hold about you if you apply to us in writing to the following email address: data@genesiscapital.co.uk
2. Agencies’ details: Please write to or telephone us if you want details of those CRs and FPs from which we obtain, and to which we pass, information about you. You have a legal right to these details.
3. Stop direct marketing: You can stop us contacting you for direct marketing purposes at any time by asking us in writing to stop.
